TalkingChina Shenzhen Attends Cross-Border Arbitration Sharing Session – A Rainstorm Lesson

On June 16, despite an orange rainstorm warning, nearly 40 attendees packed Global Law Office’s meeting room in Shenzhen for the “Enterprise Going Global Dispute Resolution & Cross-Border Arbitration Practice Sharing Session.” Most were from overseas-bound companies or law firms.

As a translation provider, I handle many litigation documents but knew little about arbitration. I did some prep work. Interestingly, two of the four speakers addressed the differences between arbitration and litigation – confirming this is a common blind spot for Chinese companies. One speaker noted that many firms ignore dispute resolution clauses during contract signing, only to regret it later.

Key takeaways:

1. **Arbitration seat and arbitrator selection** directly affect outcomes and costs. These can be “designed” at the contracting stage, not left to chance.

2. **Shenzhen vs. Hong Kong arbitration** differ significantly in cost and procedure. Hong Kong charges by the hour with uncertain final fees, while the Shenzhen Court of International Arbitration offers more predictable online processes and costs.

New Arbitration

3. **New Arbitration Law amendments** – the biggest since 2017. The term “arbitration seat” was emphasised repeatedly. Speakers advised mainland firms to negotiate favourable seats in contracts to save hidden costs.

4. **Pitfalls in arbitration clauses** – Lawyer Hu Jia shared typical “landmine” cases where vague wording led to procedural disadvantages. Such details also matter in translation.
Some content

Some content remained highly technical, but I grasped one core message: arbitration is not a remote high-end game but an essential tool for going global. The more I understand the context behind clients’ translation needs, the better I can appreciate the weight of each document and tailor our services accordingly.

As always, going global is tough – keep learning.
